Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the ATHVLVE platform (the “Platform”). The Platform is owned and operated by Kevin Kanhai, a sole trader based in Trinidad and Tobago, trading as “ATHVLVE” (“ATHVLVE”, “we”, “us”, or “our”). These Terms are a binding agreement between you and the operator. By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

Eligibility

Athletes aged 18 and over may create their own accounts. Athletes under 18 must be registered and managed by a parent or legal guardian, who is responsible for the account and for all activity on it. Scouts must be verified by ATHVLVE before they can contact athletes.

Accounts and Guardian Responsibility

You are responsible for keeping your login details secure and for the accuracy of the information you provide. Guardians are responsible for the accounts and information of the minors they manage, and for approving any contact involving those minors.

Journey Levels and Verification

The Platform displays journey levels based on the information available. Statistics may be self-reported or verified at official events. Verified status is earned only through official testing; we may correct, verify, or remove information to keep the Platform accurate and fair. Levels and information are provided for guidance and do not guarantee any outcome, opportunity, or selection.

ATHVLVE+ Membership

ATHVLVE+ is an optional paid membership. It provides convenience and presentation features only and never affects an athlete’s level, verification, or visibility to scouts. Membership is billed at the price shown at checkout and, unless otherwise stated, lasts for a set period from the date it is granted, after which it ends automatically. Membership features may change over time.

Scouts and Contact

Scouts must verify their identity before they can contact athletes; we review the information and identification a scout submits. Certain scouting features, including viewing detailed statistics and contacting athletes, require a paid Scout subscription. Contact directed at an athlete under 18 is routed to and managed by that athlete’s guardian. Scouts agree to use the Platform and any information they access solely for legitimate scouting purposes and in compliance with applicable law. Identity verification is a good-faith check of the information a scout provides; it is not a guarantee of a scout’s identity, intentions, character, or suitability. ATHVLVE does not employ, endorse, represent, or vouch for any scout or other user, and is not a party to any arrangement made between users.

Assumption of Risk and Interactions Between Users

ATHVLVE is a platform that helps athletes and scouts find and connect with one another. Any communication, arrangement, meeting, or transaction between users is solely between those users. You understand and agree that:

ATHVLVE does not screen users beyond the checks described in these Terms, does not control the conduct of any user, and is not responsible for the accuracy of information users provide, for any communications between users, for any in-person or off-Platform interaction, or for the outcome of any interaction. You interact with other users at your own risk. Guardians are responsible for supervising all contact involving a minor, and any in-person meeting involving a minor should take place only with the guardian’s knowledge and presence. To the fullest extent permitted by law, you release the operator from any claim or dispute arising out of interactions between users.

User Content

You retain ownership of the information and media you submit (such as statistics and photos). By submitting it, you grant ATHVLVE a licence to host, display, and use it as needed to operate the Platform, including showing athlete profiles to verified scouts. You are responsible for ensuring you have the right to submit any content you upload.

Acceptable Use

You agree not to: provide false or misleading information; impersonate another person; attempt to access accounts or data you are not authorized to access; misuse, harass, or attempt to make inappropriate contact with any user, especially a minor; or interfere with the security or operation of the Platform. We may suspend or remove accounts that violate these Terms.

Events

ATHVLVE may offer events from time to time, and these may not be available in all locations. Where events are listed, registration and attendance are subject to the requirements and fees shown for each event. Indicating attendance does not guarantee a place, event details may change, and ATHVLVE is not responsible for events or activities it does not itself organise.

Payments and Refunds

Payments are processed through our third-party payment provider or arranged in person. Unless required by law or stated otherwise, membership and event fees are non-refundable once the relevant period or event has begun. You are responsible for any charges associated with your purchases.

Disclaimers

The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, or that any information provided by users is accurate or complete. We do not guarantee that use of the Platform will result in scouting interest, selection, advancement, or any particular outcome. We do not endorse or guarantee the conduct of any user, including scouts.

Limitation of Liability

To the maximum extent permitted by law, ATHVLVE and its operator are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from interactions between users, the conduct of any user, or reliance on information provided through the Platform. To the maximum extent permitted by law, the operator’s total liability for any claim arising out of or relating to the Platform is limited to the greater of the total amount you paid to ATHVLVE in the six (6) months before the claim arose, or one hundred Trinidad and Tobago dollars (TT$100). Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless the operator of ATHVLVE from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Platform, the content or information you submit, your interactions with other users, or your breach of these Terms or of any applicable law.

Termination

You may stop using the Platform at any time. We may suspend or terminate access if these Terms are violated or where necessary to protect users or the Platform.

Governing Law

ATHVLVE is operated from Trinidad and Tobago and is made available to users across the Caribbean. You are responsible for complying with the laws that apply to you in your own location. These Terms are governed by the laws of the Republic of Trinidad and Tobago, without regard to conflict-of-law principles. Disputes shall be subject to the jurisdiction of its courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and continued use of the Platform means you accept the updated Terms.
